Terms & Conditions

1. Introduction

These Terms & Conditions ("Agreement") are entered into between Beatrix Creative Agency ("Agency," "we," or "us") and the client ("Client" or "you") upon your engagement of our services. By engaging our services, you agree to abide by these terms and conditions.

2. Basic Information

Services Provided:

  • Brand strategy

  • Website design

  • Social media strategy

  • Podcast & audio editing

  • Photo & video editing

  • Graphic design

  • Creative consulting (upon request)

  • Special projects (subject to agreement)

3. Payment and Pricing

Payment Structure:
Payments for our services are project-based for one-time projects and on a retainer basis for ongoing work. For one-time projects, a 50% deposit is required upon the signing of the contract. The remaining balance is due upon project completion. For retainer work, we require monthly payments.

Late Payments:
Invoices not paid within 30 days will incur a 1.5% late fee per month on the outstanding balance.

Refund Policy:
Refunds are not typically offered for completed work. However, revisions may be made within a specified time frame as outlined in the project agreement.

4. Intellectual Property

Ownership of Work:
Clients are granted a license to use the final deliverables (such as website design or branding materials) for the intended purposes. The Agency retains the right to display the work in our portfolio and case studies unless explicitly requested otherwise by the Client.

Use of Client Materials:
We may use work created for you in our portfolio, website, and other marketing materials unless you request otherwise in writing.

5. Liability and Disputes

Limitation of Liability:
The Agency is not liable for any indirect, incidental, or consequential damages arising from the use of the services provided.

Dispute Resolution:
In the event of a dispute, both parties agree to first attempt to resolve the matter through mediation. If mediation fails, arbitration will be pursued as a next step. Legal jurisdiction for any disputes will be Illinois or Cook County.

6. Privacy and Confidentiality

Confidentiality:
We agree not to disclose any confidential information provided by the client, including but not limited to business strategies, proprietary information, and financial data, unless authorized by the client.

Data Privacy:
We take your privacy seriously and will never share your personal information without your consent, except as required by law.
